Terms of Service

These terms govern your use of software sold by Donald Proctor, a sole proprietor trading as Rippy Productions, of Birmingham, Alabama, United States (“we”, “us”). They apply to Wingman Protocol, Ask Donnie, and any other software we offer. By creating an account or making a purchase, you agree to them.

What we provide

We provide access to hosted software over the internet. We do not sell physical goods and nothing is shipped. Access is granted for the plan and period you purchase.

Accounts

You are responsible for keeping your credentials and API keys secure and for all activity that occurs under them. Tell us promptly at admin@wingmanprotocol.com if you believe a key has been exposed, and we will revoke and reissue it.

Payment and renewal

Prices are in United States dollars. Card payments are processed by Stripe; we do not store full card numbers. Some usage may be settled in USDC on the Base network.

Subscriptions renew automatically for the same period until cancelled. You may cancel at any time, and cancellation takes effect at the end of the current billing period. Metered usage is billed for calls actually made.

Subscriptions purchased inside our iOS apps are billed by Apple through your App Store account and are managed in your Apple subscription settings, not by us.

Acceptable use

You agree not to use the software to:

• break the law or infringe anyone’s rights;
• send unsolicited bulk messages, or attempt to gain unauthorised access to any system;
• overload, probe, or disrupt our infrastructure or that of third parties; or
• resell or redistribute access in a way that circumvents your plan limits.

We may suspend access that we reasonably believe breaches these terms.

Availability

We work to keep our services available but do not guarantee uninterrupted operation. We may change or discontinue features. If we discontinue a paid service entirely, we will refund the unused portion of any prepaid period.

Your content

You keep ownership of the data you send to our services. You grant us only the permission we need to operate the service for you — to store, process, and transmit that data.

Liability

The software is provided “as is”, without warranties beyond those that cannot be excluded by law. To the fullest extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us for it in the twelve months before the claim.

Changes and governing law

We may update these terms; material changes will be reflected in the “last updated” date above. These terms are governed by the laws of the State of Alabama, United States.
